EXTENSION OF DECLARATION OF PROTECTIVE COVENANTS, RESTRICTIONS, RIGHTS AND RESERVATIONS FOR S0UTHF1ELD ESTATES, SANDWICH, BARNSTABLE COUNTY, MASSACHUSETTS
Southfield Residents Association, Inc. (hereinafter referred to as the "SRN'), by its duly elected officers and the undersigned, each being a Member of SRA (as defined in Section 1, et seq. of Southfield Residents Association, Inc., a Massachusetts nonprofit corporation duly organized under General Laws, Ch. 180), and each being an Owner of one or more Lots (as defined in Section I, et seq. of the Declaration of Protective Covenants, Restrictions, Rights and Reservations for Southfield Estates, Sandwich, Barnstable County, Massachusetts dated March 21, 1985, and recorded in the Barnstable Land Registry District as Document No. 359,922 under certificate of Title No. 99,664 and by assignment to SRA by Document No. 683,825 (hereinafter referred to as the "Restrictions) of certain real property situated in the Town of Sandwich, Barnstable County, Massachusetts being shown as Lots 4 through 187 on a Plan entitled "Subdivision Plan of Land in Sandwich, Mass." prepared by Crowell & Taylor Corp., Wilfred E. Taylor Surveyor, dated April 13, 1973, and being Land Court Plan No. 35769B and recorded with the Barnstable Land Registry District with Certificate No. 56,155 and Lots 3 through 29 on a Plan entitled "Subdivision Plan of Land in Sandwich, Mass." prepared by Crowell & Taylor Crop., Wilfred E. Taylor, Surveyor dated May 17, 1973, and being Land Court Plan No. 36266B and recorded with the Barnstable Land Registry District with Certificate No. 60,537, which Plans reference may be made for a more particular description of the Premises.
WHEREAS, the right to enforce the Restrictions has been assigned to SRA by virtue of an Assignment dated May 20, 1996, and recorded with the Barnstable County Land Court Registry District as Document No. 683,825; and
WHEREAS, said Restrictions will by their terms expire as of December 31, 201O; and WHEREAS, the Members, and Lot Owners wish to extend the Restrictions until December 31, 2030, as permitted by Section 5 of the Restrictions and G.L. c. 184, §27; and
WHEREAS, the SRA and its Members/Lot Owners hereby extend the Restrictions of the SRA as set forth below.
NOW THEREFORE, come the undersigned and agree as follows:
That pursuant to Section 5, the Restrictions be, and hereby are, extended until December 31, 2030, and that this document be executed by the record owners of not less than fifty (50%) percent of the Lots of the Southfield Estates Subdivision and recorded at the Barnstable Land Registry District.
In all other respects, the Restrictions, as extended, are wholly ratified and affirmed as if fully set forth herein.
EXECUTED as a sealed instrument this 22nd day of December 2010, as an Extension of the Declaration of Protective Covenants, Restrictions, Rights and Reservations for Southfield Estates, Sandwich, Barnstable County, Massachusetts dated March 21, 1985, and recorded with the Barnstable County Land Court Registry as Document No. 359,922, as aforesaid by SRA and the following record Members/Owners of Lots attached hereto:
